Licensing agreement for the end user of Clippy in versions ClippyPro and ClippyFree
PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THIS SOFTWARE

This licensing agreement (LICENSE FOR END USER) is a legal agreement between you and Tamio Patrick Honma for the software Clippy in its version ClippyPro and ClippyFree which contains the main program Clippy exe, the system extension OSD.ocx and the documentation. The redistributed system extensions of Microsoft Inc. are subject to the provisions of Microsoft.

1. THIS LICENSE: This license becomes valid with the installation of the program. Should you not consent to this licensing agreement please deinstall the program immediately. Should individual clauses of this agreement prove to be illegal, invalid or not enforceable this will lead to the invalidity of the clauses concerned but not to the invalidity of the whole agreement.

2. CLIPPY; CLIPPYPRO AND CLIPPYFREE: This license distinguishes between Clippy, ClippyPro and ClippyFree. The name Clippy includes the software versions ClippyPro and ClippyFree. ClippyPro is the shareware version for which usage is liable to charges (see article 3.b). ClippyFree is the freeware version which can be used free of charge (see article 3.e).

3. SOFTWARE USAGE
3.a)PRIVATE AND COMMERCIAL USAGE OF CLIPPYPRO: This licensing agreement differentiates between private end users and commercial end users. Private end users are those using the software on their home pc, in their private home, for private (non commercial) purposes. Commercial end users are those using the software at work for commercial purposes. Commercial purposes are all purposes meant to earn corporate, organisational or personal gain.
3.b) CLIPPYPRO FEE: To use this software it is necessary to pay a fee. The amount payable complies to the private or commercial usage of the software as describe in article 3.a. Before payment of the license fee Tamio Patrick Honma allows you usage for a period of 30 consecutive days after the first installation of the software. Should you exceed this period of time deinstall this software. The license fee covers usage for one generation of the software. A generation is marked by the first version number of the software. If the generation changes installation of the program version concerned will be subject to a special upgrading fee.
3.c) PRIVATE END USERS OF CLIPPYPRO: Private end users (see article 3.a)) can with this license install this software on all home pcs of all members of the household and use it. The members of the household are allowed to use the software on the household's computers. A household is a confined area of cohabitation in a house, a flat or an apartment.
3.d) COMMERCIAL END USERS OF CLIPPYPRO: Commercial end users (see article 3.a)) can with this license install and use the software on all work stations of a department within an organisation. The members of the organisational unit (department) are allowed to use the software as well.
3.e) USAGE OF CLIPPYFREE: ClippyFree can be used unrestrictedly.

4. COPYING THE SOFTWARE: It is explicitly allowed to copy ClippyFree as well as the unregistered version of ClippyPro as-they-are. No changes may be made to the distribution (archive content, content of original disk, of original CD-ROM etc.).

5. REGISTRATION DATA FOR CLIPPYPRO: Data required to register for ClippyPro are first name, name (company name/ name of organisation), city and serial number of licensee. In no form must the data to be registered be made public (beyond the household for private users (see article 3. c) or beyond the organisational unit for commercial users (see article 3. d)). No data may be used for registration which does not apply to this licensing agreement (see mainly article 3). To use such registration data is liable to prosecution. No programs must be brought into circulation which allow for the illegal generation of registration data (especially serial numbers). Usage of the illegal programs to generate registration data is also prohibited. It is not allowed to make changes to the software ClippyPro, especially (but not exclusively) to bypass registration. Tamio Patrick Honma reserves the right to block registration data brought into circulation whereby registrations made with these registration data become invalid and usage of the software becomes impossible. Blocking for this reason does not allow for a refund of the licensing fee. Tamio Patrick Honma also reserves the right to acquire information on the licensee whose registration data was brought into circulation and to take legal steps.

6. NETWORK
6.a) ALLOCATION OF CLIPPYPRO: ClippyPro, within the set regulations for usage of the software (see article 3), may be made accessible with the registration data on file servers or similar network services in a household or organisational unit (department).
6.b) ALLOCATION OF CLIPPYFREE: ClippyFree can be made available without any restrictions.

7. WARRANTY EXCLUSION: Tamio Patrick Honma does not grant any warranty or guarantee for this software.

8. LIMITATION OF LIABILITY: Liability for any subsequent damages, including liability compensation and lost gain is excluded. Exclusion of liability also applies to possible demands of a third party.

9. APPLIABLE LAW: Place of jurisdiction is Dsseldorf, Northrhine-Westphalia, Germany.

10. TRANSFER OF LICENSE TO CLIPPYPRO: You must not sell, rent out, lease, underlicense or lent the software. This license is not transferable to a third party.
